Armed Forces Compensation Scheme
The Armed Forces Compensation Scheme (AFCS) compensates for any injury, illness or death which was caused by service on or after 6th April 2005 (if prior to this date you can claim under the War Pension Scheme )
If eligible and awarded, this can be:
- A tax free lump sum payment
- A guaranteed Income Payment (GIP) which is a tax fee, index linked monthly payment.
There is a tariff table for each type of injury and graded in severity, and you must meet these criteria. The maximum tariff is £650,000 and the minimum £1,236.
This scheme is managed by Veterans UK and you would apply to them directly.
Time limits for claims
Claims for injury or illness must be made within 7 years of the earliest of the following dates:
- the date of the incident leading to the injury or illness
- the date on which an injury or illness not caused by service was made worse by service
- in the case of illness, the date of first seeking medical advice for that illness
- the date of discharge.
Civil claims, unlike AFCS claims, are not capped by a tariff and could have a higher rate of compensation. Military Personnel and veterans could consider civil claims for:
- Asbestos Claims
- Cold injury
- Serious Injury
- Hearing loss
